Terms and conditions
1. travel services, registration:
The scope of the contractual services of the trips, is described on the corresponding travel descriptions. Steppenfuchs Reisen does not owe any further services. With the written registration, or by email, the travel participant offers Steppenfuchs Reisen the conclusion of a binding travel contract. The travel contract comes into effect with the written confirmation of the registration by Steppenfuchs Reisen . If the content of the confirmation deviates from the content of the registration, Steppenfuchs Reisen has a new offer to which the tour operator is bound for a period of 10 days. The contract is concluded on the basis of this new offer if the participant declares acceptance to Steppenfuchs Reisen within the binding period.
Without payment of the entire travel price, the participant has no right to the provision of travel services by Steppenfuchs Reisen. After conclusion of the travel contract, the participant receives the booking confirmation. Upon receipt of the booking confirmation, the deposit stated in the booking confirmation is due. The remaining travel price is to be paid at the latest 35 days before the start of the trip. For bookings made less than 35 days before the start of the trip, the entire tour price is due upon receipt of the booking confirmation. If payment is not received until shortly before the start of the trip, the customer shall bear the additional costs of express delivery of the travel documents, insofar as the customer is responsible for the delay in receipt of payment. The travel price and the services included therein can be found in the individual travel descriptions. The mentioned prices are valid for the respective season. Payment via a credit card system is expressly excluded.
3. minimum number of participants:
Steppenfuchs Reisen reserves the right to cancel a tour if fewer participants have booked than the minimum number of participants stated in the tour description. In this case we will inform you immediately and refund the entire amount paid. Individual tours, are excluded from this regulation. Alternatively, Steppenfuchs Reisen can offer a small group surcharge if the minimum number of participants is not reached, in order to ensure the implementation of the trip.
4. changes in described event procedures, price increases:
Changes or deviations of dates, individual travel services from the agreed content of the travel contract, which were not brought about against good faith, are only permitted insofar as the changes or deviations are not significant and do not affect the overall nature of the booked trip. Possible warranty claims remain unaffected insofar as the changed services are defective. Steppenfuchs Reisen is entitled to increase the tour price if the following price components increase or arise after the conclusion of the contract due to unforeseeable circumstances,
Foreign exchange rates for the trip in question;
Transport tariffs and prices;
oder sonstige behördliche Abgaben einschließlich Flughafen- und Sicherheitsgebühren.
However, the price increase is only permissible if there is a period of more than 4 months between the conclusion of the contract and the start of the trip. Should this be the case, the customer will be informed immediately, but no later than 3 weeks before the start of the trip. Price increases thereafter are no longer permissible. In the event of a price increase of more than 5% of the travel price, the customer is entitled to withdraw from the trip within 10 days free of charge. The travel participant can demand participation in an equivalent trip, if Steppenfuchs Reisen is able to offer such a trip without additional costs. The tour participant must assert these rights in writing to Steppenfuchs Reisen immediately after Steppenfuchs Reisen’s declaration of the price increase or change to the tour.
5. cancellation, substitute persons, rebooking, non-arrival and non-utilization of services:
The travel participant can withdraw from the trip at any time before the start of the trip. He also has the right to demand that a third party takes part in the trip instead of him until the start of the trip. Steppenfuchs Reisen may object to the participation of a third party if this third party does not meet the special travel requirements or if his participation is contrary to legal regulations, including those of the country of travel, or official directives. If a third party enters into the contract, the travel participant and the third party are liable to Steppenfuchs Reisen as joint and several debtors for the tour price and the additional costs incurred. Decisive for the calculation of all deadlines – also in case of withdrawal by telephone – is the receipt of the written declaration by Steppenfuchs Reisen. In each case of withdrawal by the travel participant, a flat-rate pro-rata processing fee of € 25,– per person will be charged. Apart from that, Steppenfuchs Reisen is entitled to the following payments in case of cancellation by the travel participant:
up to 60 days before departure 10% of the travel price, but at least € 25,– handling fee per person
up to 35 days before departure 25% of the tour price
up to 14 days before departure 50% of the tour price
up to 5 days before departure 90 % of the tour price
from the 4th day, until the start of the trip or in case of no-show to the event 100% of the tour price.
These payments are the lump sum compensation, unless Steppenfuchs Reisen can prove that the claim for compensation remaining after deduction of saved expenses would have been higher. The right of the travel participant to prove to Steppenfuchs Reisen a lower claim for compensation than requested remains unaffected. If the travel participant does not show up or shows up late for the beginning of the trip or for the departure or departure flight, if he/she cancels the trip on the day of departure or for reasons for which Steppenfuchs Reisen is not responsible, or if he/she has to be excluded from the start or continuation of the trip, Steppenfuchs Reisen will retain the full claim for payment. Any additional costs incurred by Steppenfuchs Reisen due to efforts to bring the traveler to his/her destination or to transport him/her further will be borne by the traveler. A refund will only be made to the extent that Steppenfuchs Reisen is reimbursed for services not used by the service providers. Rebooking requests made by the traveler after the expiration of the above deadlines, if their implementation is possible at all, can only be fulfilled after withdrawal from the travel contract by re-registration of the traveler.
6. delay, extraordinary circumstances
Wird die Reise infolge bei Vertragsabschluss nicht voraussehbarer höherer Gewalt erheblich erschwert, gefährdet oder beeinträchtigt, so können sowohl Steppenfuchs Reisen als auch der Reiseteilnehmer den Reisevertrag kündigen. Wird der Vertrag gekündigt, so kann Steppenfuchs Reisen für die bereits erbrachten oder zur Beendigung der Reise noch zu erbringenden Leistungen eine angemessene Entschädigung verlangen. Steppenfuchs Reisen ist in diesen Fällen verpflichtet, die notwendigen Maßnahmen zu treffen, insbesondere falls der Vertrag die Beförderung umfasst, den Reiseteilnehmer zurückzubefördern. Die Mehrkosten für die Rückbeförderung sind von den Parteien je zur Hälfte zu tragen. Im Übrigen fallen die Mehrkosten dem Reiseteilnehmer zur Last.
If the trip is significantly impeded, endangered or impaired as a result of force majeure that was not foreseeable at the time the contract was concluded, both Steppenfuchs Reise and the tour participant may terminate the travel contract. If the contract is terminated, Steppenfuchs Reise may demand reasonable compensation for the services already rendered or still to be rendered for the termination of the trip. In such cases, Steppenfuchs Reise is obligated to take the necessary measures, especially if the contract includes transportation, to transport the traveler back. The additional costs for the return transport are to be borne by the parties in equal parts. In all other cases, the additional costs shall be borne by the traveler.
7. documents, passport, foreign exchange, customs and health regulations.
Steppenfuchs Reisen informs the travel participant about the regulations of passport, visa, customs and health regulations of his vacation country. The travel participant is obliged to disclose particularities in his person and in that of his fellow travelers, which are important in connection with these regulations. Each travel participant is responsible for compliance with the relevant regulations in the countries he or she travels to. All disadvantages resulting from non-compliance with these regulations are at the expense of the travel participant, except if they are caused by culpable misinformation or non-information on the part of Steppenfuchs Reisen.
8. warranty, duty to cooperate, remedy request
The participant can demand compensation for non-performance without prejudice to reduction or cancellation, unless the deficiency of the trip is based on a circumstance for which Steppenfuchs Reisen is not responsible. In the event of any service disruptions, the traveler is obligated to do everything reasonable to contribute to the elimination of the disruption or to keep damages to a minimum. All complaints are to be reported immediately to the responsible tour guide. If a tour guide is not available, complaints must be made directly to Steppenfuchs Reisen without delay. Prior to termination, Steppenfuchs Reisen must be given a reasonable period of time to remedy the situation, unless remedy is impossible or refused by Steppenfuchs Reisen, or if immediate termination of the contract is justified by a special interest of the customer. Claims for reduction and compensation have to be asserted by the customer to Steppenfuchs Reisen within one month after the contractual termination of the tour. After the expiration of this period, the traveler can only assert claims if he was prevented from meeting the deadline through no fault of his own. The claims become time-barred after 6 months. The statute of limitations begins on the day on which the trip was supposed to end according to the contract. If the customer has asserted claims, the limitation period is suspended until the day Steppenfuchs Reisen rejects the claims in writing.
9. participant assurance
The participant assures to be the holder of a valid driving license (motorcycle tours and jeep self-driving tours). He drives at his own risk and participates in the trip with his motorcycle (except trips with rental motorcycle / jeep), which must be approved for public road traffic and in safe driving condition. The rules of the StVO and StVZO (or the road traffic regulations of the respective travel countries) as well as the legal provisions for liability and vehicle insurance apply. There is no additional insurance on the part of Steppenfuchs Reisen. The participant assures to take part in the event only with proper motorcycle protective clothing (helmet, outer clothing, gloves, boots). Recommendations and minimum requirements for protective clothing can be found in the participant documents or can be requested.
10. compliance with instructions
If the participant violates protection regulations or if the other participants or the proper execution of the trip are endangered or injured or damaged by his behavior, the representatives of Steppenfuchs Reisenn have the right to exclude the participant from further participation in the trip without reimbursement of his participation fee and incurred costs. The participant assures that he/she will follow the instructions of the motorcycle guide / guide during jeep tours on the route.
11. tour guide
The tour guides are not authorized to make legally binding declarations for Steppenfuchs Reisen. They are also not allowed to hand over to the participants any vehicles or equipment belonging to or entrusted to Steppenfuchs Reisen.
The participant declares by his signature that he takes part in the trip at his own risk. He assumes the civil and criminal responsibility for any damage he may cause (e.g. personal injury, property damage and consequential damage) and provides himself for sufficient health insurance coverage. He/she waives any claims against Steppenfuchs Reisen its employees as well as against all tour guides, helpers, agents and other vicarious agents entrusted with the tour, which arise in connection with a damaging event during the booked tour. This waiver is also declared to the participant’s relatives and dependants. Furthermore, the undersigned indemnifies Steppenfuchs Reisen and its employees from claims of third parties which are asserted in connection with a damaging event caused or contributed to by him/her. Liability due to intentional damage and gross negligence by Steppenfuchs Reisen remains unaffected. As far as Steppenfuchs Reisen uses the services of vicarious agents or other third parties, Steppenfuchs Reisen is only responsible for a careful selection as well as for the usual supervision. In particular, Steppenfuchs Reisen does not assume any liability for damages caused by an improper condition of the route. The liability towards the traveler for damages from contractual claims arising from the travel contract is, except for bodily injury, limited to three times the price of the trip insofar as damage to the traveler was not caused by gross negligence or intent or Steppenfuchs Reisen is responsible for damage incurred by the traveler solely due to the fault of a service provider. Steppenfuchs Reisen is not liable for service disruptions in connection with services that are merely recommended or arranged as external services (sporting events, exhibition visits, other sightseeing etc.) and which are expressly marked as external services in the travel description. A claim for damages against Steppenfuchs Reisen is limited or excluded to the extent that, due to international agreements or legal regulations based on such, which are applicable to the services to be provided by a service provider, a claim for damages against the service provider can only be asserted under certain conditions or restrictions or is excluded under certain conditions. If Steppenfuchs Reisen has the position of a contractual air carrier, liability is governed by the provisions of the Air Transport Act in conjunction with the international conventions of Warsaw, The Hague, Guadalajara and the Montreal Agreement (only for flights to the USA and Canada). The Warsaw Convention generally limits the carrier’s liability for death and personal injury and for loss of or damage to baggage. If in other cases the carrier is the service provider, Steppenfuchs Reisen is liable according to the provisions applicable to them.
13. accident insurance
There is no accident insurance. Each participant must take out accident insurance himself.
14. travel cancellation insurance / protection letter
We recommend the conclusion of a travel cancellation insurance as well as a protection letter and advise you gladly.
The place of jurisdiction for lawsuits against Steppenfuchs Reisen is Ulaanbataar (Mongolia). The invalidity of individual provisions of the travel contract does not result in the invalidity of the entire contract. Rather, the parties undertake to find a regulation that comes closest to the original version.
